In a world where justice should prevail, my journey as an osteopath has taken an unexpected turn. My name is Michelle of the family Davies. I am a dedicated and compassionate healthcare practitioner fighting an uphill battle against a regulatory system that seems to have lost sight of its mission. Today, I invite you to join me in supporting my pursuit of fairness, transparency, and the preservation of my professional reputation.
A Lifelong Commitment to Healing
For nearly three decades, I have been on a dedicated journey in the field of osteopathy. My passion for this practice led me to study osteopathy at an honours degree level, investing four years of rigorous education from 1993-1997. Throughout this extensive period, my life has revolved around the principles and practices of osteopathy.
My commitment to helping others has left a lasting impact on countless individuals who sought relief from pain and suffering. My patients, over the years, have not only experienced physical and emotional healing but have also found solace in the knowledge that they are under the care of a dedicated and genuine professional.
However, my unwavering path took an unexpected and challenging turn when I found myself entangled in a web of allegations brought forth by the General Osteopathic Council (GOsC). These allegations stemmed from claims I made against the GOsC. Instead of conducting an impartial investigation into these claims, they initiated legal proceedings against me. The outcome of this process was an interim suspension order in October 2021. Unfortunately, the GOsC has not extended the courtesy of allowing me to defend my case openly and transparently.
This situation has resulted in a complex entanglement involving suspension, allegations, regulatory procedures, and an unexpected criminal conviction. Remarkably, this criminal conviction occurred one year after the initial allegations were levelled against me in 2021. To be specific, the conviction I faced was related to charges of impersonating an osteopath on my website.
A Call for Transparency
One of the central issues I've encountered lies in the murkiness surrounding the regulatory process. My suspension without the benefit of a fair trial has left me in a perplexing and disheartening situation. Despite my unwavering commitment to adhering to the highest ethical and professional standards throughout my career, I found myself entangled in a bureaucratic maze that has cast a shadow over my professional future.
"In 2021, my claim against the regulator was centred on the restriction of my advertising and the suppression of public testimonials, totalling 75 in number. This censorship of public voices dates back to 2016, posing a significant risk to the public's ability to express their experiences and opinions. Paradoxically, while the regulator's primary mandate is to safeguard public health, their actions have stifled the public's voice, undermining their own mission."
Striving for Justice
One of the most prominent issues that demands our attention is the suspension I faced without the opportunity for a fair trial a cornerstone of justice that should be accessible to all. Unfortunately, this fundamental principle seemed elusive as I navigated a complex and seemingly inequitable system. The absence of due process not only hindered my ability to present my case but also cast doubt on the system's capacity to uphold justice.
I've had the opportunity to present my side in three distinct hearings in 2021, one of which occurred in London, while the others were remote. Remarkably, despite these extensive hearings, the General Osteopathic Council (GOsC) has consistently maintained that these were not substantive hearings, leaving the substantive evidence unexamined.
These hearing boasted the full committee, including the chairman, barrister, legal adviser, and a panel of 1 or 2 osteopaths and laypeople. Nonetheless, despite its comprehensive nature, the GOsC determined that these hearings lacked any fact-finding component.
These circumstances raise substantial questions about the nature of the GOsC's allegations and the evidential basis supporting them. It's vital to note that I've actively cooperated throughout these proceedings, offering my evidence and patiently awaiting the opportunity to defend myself against the evidence presented by the GOsC. Yet, the situation remains uncertain, and it is perplexing that despite these multiple hearings, the substantive evidence has yet to be presented. This situation underscores the need for scrutiny and emphasizes the importance of ensuring that all facets of the case are meticulously and impartially examined.
