Aim

Ensure the new UK law banning the misuse of NDAs protects all workers and is implemented with watertight regulations.

Non-disclosure agreements (NDAs) were designed to protect business information - but over time, they’ve been weaponised to hide harassment, discrimination and abuse. They silence victims, protect perpetrators, and allow toxic cultures to thrive.

After years of campaigning, the UK Government has finally taken action.

The Employment Rights Bill now includes landmark NDA reform (Clause 202A) that will make gagging clauses legally void if they stop someone speaking about workplace harassment or discrimination, or how their employer handled it. The Bill recieved Royal Assent at the end of 2025 – a historic shift for workers’ rights.

But our work isn’t finished yet...

The Government will soon consult on the regulations that decide what kinds of NDAs will still be allowed and under what conditions. These details will determine whether the new law truly protects victims, or whether employers can still exploit loopholes to silence them.

We’re calling for strong, victim-centred rules that guarantee:

• Confidentiality can only be included at the request of the victim, with no employer pressure.

• Victims receive independent legal advice, paid for by the employer.

• NDAs include a cooling-off period and can be time-limited.

• Victims can always speak to trusted people, like their doctor, lawyer, therapist, regulator, or a family member, without breaking the law.

The Government has also introduced a Victims and Courts Bill amendment, ensuring victims and witnesses of crime who signed NDAs will no longer be silenced. It guarantees they can speak about criminal conduct, to anyone, for any reason.

Together, these reforms represent a huge cultural shift in how the UK treats victims – but we must make sure they are implemented properly.

✅ Higher Education (Freedom of Speech) Act (2023) – Banned English universities from using NDAs to cover up sexual misconduct.

✅ Victims and Prisoners Act (2024) – Made NDAs unenforceable if they prevent someone reporting a crime or seeking support.

✅ Worker Protection Act (2024) – Created new employer duties to prevent sexual harassment, with tougher penalties.

✅ Employment Equality Act Amendment (Ireland, 2024) – Restricted NDA misuse at a national level.

✅ Employment Rights Bill (UK, 2025) – Landmark NDA reform (Clause 22A) to void gagging clauses covering harassment and discrimination.

✅ Victims and Courts Bill (UK, 2025) – Expands NDA protections to cover all victims and witnesses of crime.

✅ Legal Sector Reform – Triggered stronger guidance from the Solicitors Regulation Authority and Law Society.
