I am reaching out to you with a heartfelt plea for justice and compassion. A distressing incident involving an autistic individual has come to light, and we are committed to ensuring that their rights are upheld and their story is heard. This incident occurred when an autistic man was subjected to unwarranted violence and wrongful restraint by a security guard at a Tesco store.
The lawyer representing me which is Donoghue Solicitors said my case has reasonable prospect of success and is representing me on a no win no fee basis however I have to pay disbursements such as Court fees and Expert reports which my lawyer estimates will be in the region of £3,000.00 - £5,000.00.
The Unfortunate Incident:
In an appalling act of injustice, this innocent autistic individual was wrongfully targeted, physically beaten, and held against his will by a security guard at a local Tesco store. The incident took place on 21/11/2021, leaving the victim traumatized and his loved ones devastated. The victim's vulnerability and unique needs were ignored, resulting in a horrifying experience that no one should ever have to endure.
Our client purchased some items using the self-checkout till. Our client used the Tesco
PayPlus app on his mobile telephone to do so. He was not provided with a receipt.
Our client understands that this is normal when using the PayPlus app.
As our client attempted to exit the store, a security guard gestured towards our client.
Our client was wearing large over the head headphones with music playing so could not hear what the security guard was saying.
Our client removed his headphones whereupon the security guard demanded to see his receipt for the items that he had just purchased.
Our client explained that he did not have a receipt as he paid using the PayPlus app.
The security guard was situated on the other side of a display separating the ‘entrance’ and ‘exit’ doors.
Our client therefore attempted to walk around the display so as to avoid shouting to the security guard. As our client did so, the security guard rushed towards our client and kicked him heavily in the back of the leg while simultaneously pushing his torso backwards causing him to fall to the ground. Our client banged his head heavily on the floor.
The security guard proceeded to pin our client to the ground. Our client was shocked and could not understand what was happening.
Our client, knowing that he had done nothing wrong, attempted to get to his feet. He was unsuccessful as the security guard kept him pinned to the ground.
At this point, several customers had gathered around to see what was going on.
Our client felt humiliated and embarrassed. He could not understand why he was being subjected to such force.
He tried to explain to the security guard that he had paid for his items and that this could be verified by the PayPlus app. The security guard ignored our client’s protests and refused to check his mobile telephone.
One customer, who our client now knows to be an off-duty police officer, eventually telephoned the police.
Several uniformed police officers attended the scene shortly thereafter.
At this point, the security guard allowed our client to get to his feet. Our client remained pinned down on the ground for approximately 20 minutes by the security guard.
Our client was then escorted by the security guard and the police officers into a room at the rear of the store. Several customers were staring at him. Our client felt like a criminal. Once again, he was extremely embarrassed by this.
Once he was in the room, our client explained to the police officers that he had paid for every item in his bag. He produced the PayPlus app on his mobile telephone which confirmed this. A member of staff then price checked all of the items in our client’s bag which matched the figure displayed on the PayPlus app, thus verifying our client’s story.
Our client was then allowed to leave. He was not afforded any explanation as to the brutal use of force nor an apology for the injury, distress and humiliation caused.
