The senior complaints manager from the bank rang to apologise and stated that this should never have happened to Michael. The repossession order will be rescinded and the equitable charge will be discharged.
Michael is over the moon and now can rest at ease that his home won’t be taken away from him.

Michael Drew, an 80-year-old gentleman with Asperger’s, is fighting an uphill battle to save his home from repossession. Despite never missing a single mortgage payment, Santander Bank is moving to take his property due to a dormant equitable charge on the deeds—a relic from over 25 years ago that should no longer be enforceable under the Limitation Act 1980.
Michael has secured a valuation from Standard Life to pay off the remaining mortgage of £16,026.86 in full, but the dormant charge is blocking the funds from being released. This unnecessary roadblock has put him at risk of homelessness and caused enormous emotional distress.
