The Cause
WE NEED YOUR HELP!
Thousands of terminally ill women in England, Wales, and Northern Ireland are being denied a life-extending drug called ENHERTU to treat their advanced breast cancer. Despite petitions, protests, campaigns, and even government pressure, the secondary breast cancer community continues to face constant rejection from NICE. While Scotland has rightly approved this drug, and 25 other countries worldwide have made it available, we are at a complete loss. Why don’t they value us?
Our only option now is to pursue legal proceedings to continue the fight for those who urgently need this drug and for the thousands more who will require it in the months and years to come.

BACKGROUND
ENHERTU is a prescription drug used to treat certain types of breast cancer. It is approved in the UK on the NHS for treating HER2-positive breast cancer.
In June 2022, a key trial found that treating HER2-low metastatic breast cancer patients with ENHERTU helped keep their cancer stable for longer and increased their “overall survival”—meaning they lived longer.
Since then, ENHERTU for HER2-low patients has become the standard of care in 18 European countries, including Scotland. Recent data has shown the drug to be even more effective than previously thought, significantly stalling tumor growth compared to standard chemotherapy.
Despite this, on 29 July 2024, NICE firmly rejected ENHERTU for use on the NHS in England, Wales, and Northern Ireland for HER2-low metastatic breast cancer patients. According to Breast Cancer Now (BCN), around 50% of all breast cancers show low levels of HER2, and the charity estimates that 1,000 people a year will miss out on ENHERTU as a direct result of this decision.
This means that NICE is denying thousands of people in England, Wales, and Northern Ireland access to life-prolonging treatment and the hope of more time with their loved ones. This drug is not only widely available across the world (and the number of countries approving it is increasing month by month) but is also accessible just across the border in Scotland.
We are currently in discussions with a legal team, including the barrister who successfully reversed a decision not to approve another drug, Herceptin, for NHS use in early-stage breast cancer. We are contemplating issuing proceedings against NICE to force them to reconsider their decision, and we are calling on you for help.
The costs involved in these proceedings are significant. We ask that you please donate as little or as much as you can to support this cause and help us push NICE to reconsider their decision.
There is a group of breast cancer patients who need access to ENHERTU now. They are out of options, and this drug has been proven in clinical trials to prolong life. Additionally, there is hope for thousands of secondary breast cancer patients who rely on life-prolonging treatments to give them more time with their loved ones. We all contribute to breast cancer research and cancer initiatives, but what hope do we have if we are being denied access to groundbreaking drugs?
BEFORE DONATING, PLEASE NOTE:
- Funds raised will be used to cover legal fees and disbursements related to advice and proceedings against NICE regarding the decision to reject ENHERTU for NHS use in HER2-low patients. Please note that obtaining legal advice and contributing towards these costs does not guarantee a successful outcome. In particular, it will not ensure the availability of ENHERTU. It is possible that the advice received may recommend against continuing with the case if NICE can demonstrate that their decision was just and fair.
- There is a possibility that the impending legal proceedings might encourage the parties involved to renegotiate.
- If an agreement is reached with NICE (rendering the proceedings unnecessary), if the claim is discontinued, or if there are any remaining funds in this account once this matter is resolved, these remaining funds will be donated to secondary breast cancer research.
