Progress made so far with #BrexitJustice!

#BrexitJustice is a volunteer run crowdfunding campaign which exists to fund legal action in order to bring justice to dishonest politicians and challenge Brexit in the courts!

  1. Raise as much money as we can to ensure we have the resources required for extensive legal action
  2. Formally engage barristers, solicitors and QCs at a fraction of their normal fees/pro bono
  3. Marcus J Ball will take on the risk of being the 'claimant' on behalf of all backers (thus protecting backers)
  4. Prosecute vote leave leaders based upon fraud, misconduct in public office, undue influence and , possibly, inciting racial hatred
  5. Fund a judicial review and other legal action to prevent Brexit.

*DISCLAIMER: We will be expecting those that we do engage to work at a fraction of their market rates. The following individuals/organisations have expressed their interest in working with us. However, we are yet to exchange formal letters of engagement as funds are required before we can complete this.

Note: We have several other legal professionals who have agreed to work with us  but we are not yet at liberty to name them.

‘Should Vote Leave be prosecuted over its referendum propaganda?’ An article by Anthony Eskander

I -Misconduct in Public Office

Misconduct in public office is an offence at common law triable only on indictment. It carries a maximum sentence of life imprisonment. It is an offence confined to those who are public office holders and is committed when the office holder acts (or fails to act) in a way that constitutes a breach of the duties of that office.

II-Undue Influence

Referral of Campaigns to CPS for ‘Undue Influence’, in systematically promoting false, knowingly misleading or speculative statements, as well as incitement of fear and racial hate of “immigrants”, in order to unlawfully procure votes.

Johnson and others toured the UK on a bus on which was written "We send the EU £350 million a week let’s fund our NHS instead. Vote Leave."

Johnson and others, while making speeches, stood alongside a poster saying "Let's give our NHS the £350 million the EU takes every week"

IV-Move to ensure that article 50 will not be triggered without an Act of Parliament

We are considering partnering with a 3rd party to support their cause, details to be announced shortly

V- Seeking to impugn the referendum by Judicial Review

'These include seeking to impugn the referendum by reference to the statements of objectively untrue facts during the course of the referendum, and/or to the lack of an explanation of what Brexit would involve. The former would be comparable with an election petition, the latter with a judicial review of a consultation exercise'

VI- Incitement of racial hatred/Malicious Communications/Public Order

If press reports are accurate then racially motivated attacks have spiked as a result of the referendum and political leaders may have contributed to this rise. If we can find a case to prosecute on this basis then we will do so with great enthusiasm. The matter will be looked into once we have the legal team fully engaged.

'Racial hatred 1.41 Under the Public Order Act 1986, it is an offence to publish or distribute threatening, abusive or insulting material that is intended to stir up racial hatred or which is likely to stir up racial hatred.'

Incitement to racial hatred - sections 17-29 Public Order Act 1986

Public Order Act 1986

Malicious Communications Act 1988

Senior political leaders and teams who worked alongside them who willingly and knowingly misled the public by publishing untruths with the intent to manipulate the European Union referendum result. We are not yet able to specifically name individuals that we will bring cases against but we have much interest in investigating the following individuals* and organisations*:

*DISCLAIMER: These individuals and organisations may be completely innocent of any potential charges to be made against them. We are simply researching possibilities at this time.

Legal fees are very expensive and we potentially face several, drawn out cases. We need as much funding as we can get to ensure that we last long enough to make it through. We will be working with legal professionals on a reduced fee or pro bono status where possible. However, we are up against powerful people that are very well funded. We are going to need a war chest.

This is why we set £100,000 as our minimum goal. We will be aiming for £250,000 as our stretch goal and eventually hope to raise far more than that. The more funds we raise, the more cases we can bring  against dishonest politicians and the more resistance we can raise against Brexit.

This is a non-profit campaign. The people involved in creating this campaign are volunteering their time freely. Funds will be kept under the custody of Marcus J Ball who will distribute them as necessary to the legal teams (although they will not go unchallenged).

We don't currently plan on using the money for expenses but if we need to in the case of an emergency then we may do on a very limited basis. All finances will be available for scrutiny at the end of the project.

DISCLAIMER: There is no guarantee that this campaign will be funded successfully or that the ensuing legal action will be concluded successfully.

This will be a challenging endeavour. However, if we can combine a successful funding campaign with the best legal minds in the country and the advantage afforded by intense public pressure to pursue justice it is possible that we could win our cases.

Our advantages:

1. Barristers and QCs across the nation are angry and willing to work for a fraction of their normal fees

2. Evidence is everywhere, quotes, press, video recordings, data etc

3. There is widespread belief that this has been the most dishonest political campaign in living memory

4. Millions of people are demanding answers and so are the press, this cannot be 'swept away'

5. With enough funding and volunteers, we have a fighting chance

'Imagine a world in which politicians are too scared to lie to their people. A world in which our elected leaders are brave, decent, honest people that we can trust. I want to live in that world, I think it would be a much better place to be. I think it would attract a better kind of person into politics and be far better for our nation and for other nations around the world.

At present this world does not exist and it's our fault. Our politicians do not fear lying to us because we have not made enough effort to bring justice to them for doing so. With #BrexitJustice we're going to try and make this happen'

-Marcus J Ball

Potential advantages of preventing Brexit:

1. We can stop the £ from suffering further devaluation

2. We can regain our place as the 5th strongest economy in the world

3. We can prevent Scotland from leaving the UK

4. We can prevent great damage from befalling the EU

5. We can restore the reputation of the UK around the world

Then we can at least tell our children, and ourselves, that we tried. All backers will lose their money, there will be no refunds. Marcus may be in some significant trouble, but he is taking on the risk on behalf of all backers.

#BrexitJustice is a Crowdfunder.co.uk 'all or nothing' campaign. Meaning that if we don't raise our minimum goal of £100,000 then no backers will have their funds taken from their accounts. So, backers are not risking their money unless we have enough to do something significant with it.

Backers will not be represented in court as Marcus J Ball will be the 'claimant', This will put Marcus at risk but not the people who fund this campaign.

Crowdfunding works on the basis that a large number of people contribute fairly small amounts of money, thus greatly spreading risk.

Crowdfunder.co.uk -What is crowdfunding?

Did you work for Vote Leave or another Brexit organisation? Are you aware of evidence that we need to see? If you have some evidence/information that you want to share with us then tell us what you have! However, don't send us any actual material until we contact you directly.  Email us with your contact details on SendInYourEvidence@gmail.com

'I will not accept this because the campaign was based upon lies which they immediately backtracked upon just days after the election result was announced(this should hopefully be clear to everyone now). Their campaign was built on ignorance and emotion, not evidence.
